Generative AI Additional Terms of Use

 

Picsart offers a suite of generative AI tools (the “Picsart AI Platform”).  For purposes of these terms, the Picsart AI Platform does not include Picsart’s AI Avatar tool.  These terms, and Picsart’s Terms of Use, apply to your use of the Picsart AI Platform.  Please use the Picsart AI Platform responsibly and in accordance with Picsart’sCommunity Guidelines. 


Your Ownership Rights 

You are responsible for any text you type into, or content you upload or otherwise input to, the Picsart AI Platform (“Input”) and you represent to us that you have all necessary rights to use the Input with the Picsart AI Platform.  You are also responsible for any content that is generated when you use the Picsart AI Platform (“Output”) at any stage, including editing, saving, publicly posting (including on social media), privately sharing or otherwise making the Output available. 


As between you and Picsart, you own your Input and the corresponding Output, in each case to the extent allowable by law. You may not use your Input or the Picsart AI Platform in a way that may violate law, these terms or Picsart’s other policies, or anyone’s intellectual property, privacy, publicity or other rights.  You may not use the Picsart AI Platform in a way which may lead to unlawful or harmful Output.


Your Use of Output

You may use the Output for any legal purpose, but you are solely responsible for your use of the Output.  Picsart provides no warranties that you will be able to claim copyright ownership of any Output or that the Output will not infringe on any third-party intellectual property rights.


Your License to Picsart 

Picsart is an open community and the Picsart AI Platform is designed for the benefit of our community members.  

  • By using the Picsart AI Platform, you grant Picsart a perpetual, worldwide, royalty-free, sub-licensable, irrevocable, and non-exclusive right to (a) store, copy, use, modify, reproduce, sublicense and distribute the Input in order to provide the Picsart AI Platform to you and to improve our services and those of the third party AI providers that we use in the Picsart AI Platform to provide the services to you, and (b) host, use, reproduce, create derivative works of, publicly display, sublicense, distribute, and modify the Output, in any media now known or hereafter developed. 
  • If you use our AI Image Generator text-to-image feature, we may allow others to use and Remix your images and prompts. By default, your Input and Output may be publicly viewable and remixable.   


No Warranties

Many of the tools in the Picsart AI Platform utilize third-party AI models to generate the Output.  The Picsart AI Platform and the Output are provided “as is” without warranty of any kind, and Picsart does not warrant that the Output is accurate, reliable, correct, non-infringing, or fit for any particular purpose.  You accept that any use of the Output is at your own risk and that Picsart has no liability related to or arising from your use of Picsart’s AI Platform or the Output. 


Because of the developing nature of AI technologies, content generated by the Picsart AI Platform can vary widely in its results and might be offensive, harmful, inaccurate, or otherwise inappropriate.  You understand that by using the Picsart AI Platform you may be exposed to such content, and you agree that you will not save, share (including on social media), use, distribute, display, or otherwise make available any content that is in violation of Picsart’sCommunity Guidelines.  You can report any such content to [email protected].
